PORT AUX BASQUES – Provincial Circuit Court was held at the courthouse last Wednesday, Oct. 13 with Judge Lynn Cole presiding.
Enwood
Blaine Enwood pleaded guilty to failure to comply with an undertaking (CCC 2019 [145-4-a–]). The Crown advised it was seeking a suspended sentence and asked for a period of six months probation. In addition to the statutory conditions, they also requested that contact by Enwood with the other party be by invitation only. Judge Cole agreed but extended the probation period to twelve months.
Pelley
James Pelley appeared before the court, charged with possession of untagged salmon (WLAR2 [6-4—]). Resource and Enforcement Officer Robert O’Quinn received information that James Pelly had left Beachside, Newfoundland earlier that day with 18 salmon and was on his way to board the ferry in Port aux Basques. Pelley pleaded guilty and was given a fine of $1,000 for the untagged salmon.
Mittens sentencing delayed
Jody Anderson and Peter Rossiter were both convicted earlier this year of charges for injuring or endangering an animal (CCC 1985 [445—a–]). Anderson was present at court, but because Rossiter was experiencing flu-like symptoms he could not attend. The proceedings could not continue without both individuals present. This marks the third time that Rossiter could not attend court due to flu-like symptoms.
Rossiter stated that he did not yet undergo a COVID-19 test or arrange for one, but planned to have an ambulance take him to the hospital.
“This is a matter that was set for decision, and the court in fact has its decision ready. This is a situation where both parties need to be present giving of the decision,” said Judge Cole, who noted that she was unaware of any authority that would allow her to judge the individuals separately.
At one point Cole was forced to pause the proceedings as an unidentified woman on the conference call caused a disruption. New codes were provided by the court and the proceedings soon resumed, but the sentencing was put over for another week.
Decision on the case will continue on Friday, Oct. 22 at 1:30 P.M. at the courthouse in Stephenville.
Anderson
Jody Anderson pleaded guilty to two charges of failure to comply with a condition of a release order (CCC 2019 [145-5-a–]). Judge Cole decided that sentencing on this matter will also be made in Stephenville on Oct. 22.
Dicks
Conrad Dicks was charged with recognizance to keep the peace (CCC 1985 [810—-]). He agreed to a peace bond for six months as issued by Judge Cole.
